Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Fortiva regarding your use of the Fortiva mobile application, website, and related services (collectively, the “Service”).

If you do not agree, do not use the Service. Continued use after we publish updates means you accept the revised Terms.

Creating an account means you agree to these Terms. Connect, clubs, and gyms can lead to real-world meetups. Your safety is your responsibility: meet in public, tell someone where you are going, and leave if a situation feels wrong.

Fortiva does not supervise meetups and does not guarantee the identity, conduct, or safety of other members, clubs, or gyms.

Fortiva provides personal fitness and wellness tools, including AI meal scanning, body composition estimates, activity syncing, live workouts, GPS and treadmill cardio, Fortiva Gyms listings, Connect (people, clubs, follow links and QR), messaging, credits, and coaching features.

Content in the Service — including AI suggestions, calorie estimates, body scan outputs, GPS distances, gym listings, and coaching replies — is informational only. It is not a substitute for professional medical, nutritional, or clinical advice. Always consult a qualified professional before making decisions about your health. Gym and coach listings are directories, not a guarantee of safety, credentials, or results.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.

You must be at least 13 years old (or the minimum age required in your country) to use Fortiva. If you use the Service on behalf of a gym, studio, or other organisation, you represent that you have authority to accept these Terms and to publish listing information for that organisation.

You are responsible for messages, photos, club posts, gym details, and other content you submit. Do not harass, impersonate, spam, or share others' private information. We may remove content or suspend accounts that violate these Terms or put people at risk.

Follow links and QR codes never auto-follow another member. Blocking and privacy flags (including private accounts and who can message you) are part of the Service; circumventing them is not allowed.

You keep ownership of content you submit. You grant us a licence to host and process that content solely to operate and improve the Service, including showing public profile fields to other members as you configured.

Outdoor tracks use device GPS. Distance, pace, and maps can be wrong in poor signal, tunnels, or if you deny location. Treadmill and manual logs depend on numbers you enter. GPS is the source of truth for outdoor run and walk tracks when location is available. You agree not to spoof location to manipulate rankings, clubs, or nearby discovery.

Fortiva Gyms and coach profiles help members find places and people to train with. Listing is not an employment, agency, or insurance relationship with Fortiva unless we sign a separate written agreement.

• Operators must keep hours, equipment, prices, and claims accurate and lawful
• Coaches must not present Fortiva as a medical practice or misstate qualifications
• Membership in the app is a Fortiva feature flag, not automatically a paid gym contract
• You must not scrape member lists or use Connect for unsolicited marketing

Some features are available on a free plan with usage limits. Basic and Premium features require a paid subscription billed according to the plan you select in the Apple App Store or Google Play Store. Free includes logging, limited AI, gym browsing, GPS and treadmill tracking, and following friends. Basic adds body scans and a daily coach allowance. Premium includes higher AI limits, plans from body scans, detailed progress, creating clubs, scan packs, and the credit wallet.

• Prices and renewals are shown at purchase and managed through your store account settings
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds, where available, are handled under the policies of Apple or Google
• In-app credits (for example streak restore) are a limited licence to use a feature. They are not cash, property, or a gift card unless required by law
• We may change plan pricing or included limits; material changes will be communicated before they take effect for your next billing cycle where required

You agree to use Fortiva for fitness and wellness, and not to:

• Upload unlawful, harmful, sexual involving minors, or infringing content
• Attempt to reverse engineer, disrupt, or overload the Service
• Misuse AI, DMs, or gym listings to harass others or generate prohibited content
• Scrape, resell, or redistribute Fortiva content or outputs at scale
• Impersonate another person, gym, or coach, or fake a listing
• Use location, contacts, or member graphs for surveillance or spam

We may suspend or terminate accounts that violate these Terms or put other users, our systems, or our partners at risk.

Meal scans, body scans, and coaching rely on AI models that can make mistakes. Results may vary based on photo quality, lighting, portion visibility, and other factors. You should review AI outputs before relying on them, and you remain responsible for how you interpret and act on that information.

Fortiva, including its design, branding, software, food database, maps presentation, and documentation, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service while these Terms remain in effect. Map and places data may be provided by third parties under their own terms.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI estimates, GPS tracks, gym hours, or coach listings will always be accurate.

To the fullest extent permitted by law, Fortiva and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service, including training injuries, gym visits, or interactions with other members. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the claim, or one hundred US dollars (US$100) if you have not paid us.

You may stop using Fortiva and delete your account at any time. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including intellectual property, disclaimers, and liability limits) will continue after termination.

We may update these Terms as the product evolves. When we do, we will revise the “Last updated” date above. Material changes may also be communicated in-app or by email. Continued use after changes take effect constitutes acceptance.
